VENDORS INFO

1. Food and Merchandise vendors will be provided with a 10’ X 10’ space.  Additional space and cost will be determined by both parties.  Market vendors will share provided area in proportion to space available.

2. All vendors supply your own booth and equipment as the Unity Festival host does not provide tables, chairs or tents. Please remember to plan appropriately for possible inclement weather conditions.

3. The number and/or type of registrants may be limited based on space constraints and category registration. As registration fees greatly assist with defraying festival costs, we cannot approve any waiver of fees.

4. All registrants will receive a confirmation that will provide additional instructions and information pertaining to the Festival if necessary.

 NOTE:  In the advent of poor weather predictions for the entire day, the rain date, Sunday, August 2, 2009, shall be in effect and vendors MUST call 570-851-1930 to confirm cancellation.

Vendors will be registered upon receipt of payment and will recieve payment confirmation and vendor packet via email after payment clears.

Vendor Guidelines

1. Vendor fees are non-refundable after June 1, 2009.  The rain date is August 9, 2009. There is no refund in the event of cancellation after June due to personal/business reasons, inclement weather or other acts of nature.

2. Assignment of booth space and location is at the sole discretion of the Host. Should conditions dictate, the Hosting Sponsor reserves the right to reassign booth space and/or relocate booth space as necessary.

3. Merchandise Vendors may not sell or otherwise distribute food or food products of any kind.  Food vendors may not sell or otherwise distribute non-food “merchandise” of any kind (with the exception of items of food compliment such as plates, cups, plasticware, etc).

4. Vendor shall comply with and ensure that its employees and agents comply with all legal requirements imposed by any government agency including, but not limited to, all Pennsylvania health, food and safety regulations, Federal and State licensing and tax regulations and all applicable site regulations related to use of public space in the City of Scranton.

5. Vendor shall be liable for reimbursement to the Host for the cost of any fines or other liabilities incurred by the Host due to the failure of the Vendor to comply with all applicable licensing requirements and government, tax, public safety or any other regulations.

6. To the full extent permitted by law, the Host shall not in any manner or for any cause be liable or responsible to any Vendor or any others for any injury or damage to any person, business or property in any way related to, or arising in connection with, the Festival. Any and all claims for such injuries or damages are hereby waived and Vendor agrees to indemnify all service to their customers and agrees to hold harmless the Host and its directors, officers, volunteers, agents, and sponsors (the “Indemnified Parties”) against any and all claims, liabilities, losses and expenses, including any reasonable attorney’s fees imposed on, incurred by or asserted against Indemnified Parties caused by any act or omission of the Vendor or arising in connection with the activities conducted by the Vendor in connection with the festival.

7. The Host reserves the right to determine eligibility of any application for booth space. Vendor shall not place in the booth space any apparatus, device, equipment or material that shall in any way be objectionable to other Vendors or to spectators. The Host has the sole right to determine whether such apparatus, device, equipment or material is inconsistent with this provision and may require immediate removal.

8. Host reserves the right to prohibit the display of material that, in its opinion, is not in keeping with the nature and character of the Festival or not in harmony with other vendors.

9. No Vendor shall operate amplification equipment or voice or audio equipment.

10. Booth spaces will be staffed and operated in a professional and courteous manner at all times.

11. In the event that the premises or booth space is unavailable due to circumstances beyond the control of the Host, Vendor shall have no cause of action or claim for compensation against the Host or affiliates except for the return of any amount previously paid and in such an event, the agreement shall be terminated.

12. Vendor has the right, subject to the above provisions, to arrange material and or goods within the booth space allotted. No part of an exhibit shall extend outside of the booth space or interfere with adjoining booths. No signage or promotional materials may be posted outside the allotted space without prior permission and approval from the Host.

13. Commercial Vendors shall, at their expense, provide insurance of property against fire, theft, vandalism or destruction by any cause and have a copy of the policy submitted with this signed contract. The Host or sponsors shall in no way be liable for Vendor’s failure to obtain and retain proper insurance, and Vendor agrees to indemnify and hold harmless the Host and affiliates for any such failure.

14. On the day of the event, Vendors may begin booth set up at 6:am and must complete set up by 10:am.

15. Vendor must at the end of day, remove all property, goods and materials brought into the Festival area. Vendor shall leave said space clean and free from all rubbish. All rubbish must be disposed of according to festival Site Guidelines.

16. The Host shall in no way be liable for the Vendor’s failure to make provisions to safeguard all materials, equipment and displays at all times. The Vendor agrees to indemnify and hold harmless the Host and affiliates for any such failure to make these provisions.

 

Please review all requirements and provisions related to booth space. Failure to comply with provisions of this agreement and all applicable City of Scranton regulations will result in denial of access to booth space and forfeiture of any fees and may result in reimbursement to the Host and/or affiliates of government-imposed fines and penalties.
